Terms of Service

Cherry helps people create and share Gift Profiles so friends and family can choose better gifts. By creating an account, opening a shared Gift Profile, or using Cherry, you agree to these terms and the Privacy Policy.

You must be at least 13 years old to use Cherry. If you are under the age of majority where you live, you may use Cherry only with permission from a parent or guardian. Do not use Cherry if you are not allowed to accept these terms.

• Use accurate account information and keep your login secure.
• Email verification may be required before sharing a Gift Profile, claiming guest context, or using trust-sensitive features.
• You are responsible for activity under your account unless the activity happened because Cherry failed to use reasonable security.
• Cherry may suspend or limit accounts that create risk, abuse the service, violate these terms, or interfere with other users.

You control what you add to your Gift Profile. A shared link may let anyone with the link view the profile summary, gift notes, preferences, and product cards, depending on your visibility settings. Treat shared links as shareable by recipients and avoid saving private details that are not needed for gift shopping.

Shoppers may mark gifts as purchased to reduce duplicate gifts. Cherry is designed to protect surprise details from the profile owner, but you should not use purchase marks for confidential communications or sensitive information.

Gift suggestions, product details, prices, images, availability, and retailer information can be incomplete, delayed, or wrong. Always check the retailer page before buying, especially for size, color, compatibility, shipping, return windows, price, and safety details.

Cherry recommendations are suggestions, not guarantees that a product will be the right fit, safe for a recipient, available from a retailer, or appropriate for a particular occasion.

Cherry is not the seller of retailer products and does not process checkout, payment, shipping, returns, warranties, recalls, taxes, or customer service for retailer purchases. Those issues are handled by the retailer under the retailer's own terms and policies.

Some retailer links may be affiliate links. Cherry may earn a commission if a shopper opens or buys through those links, at no extra cost to the shopper. Sponsored placements should be labeled when they appear.

You keep ownership of profile details, notes, product links, images, and other content you add to Cherry. You give Cherry permission to host, copy, display, transform, analyze, and share that content as needed to operate Cherry, personalize gift suggestions, honor your visibility settings, provide shopper views, prevent abuse, and improve the app.

Do not add content you do not have the right to use, content that is unlawful or harmful, or someone else's sensitive personal information without permission.

• Do not use Cherry to harass, deceive, stalk, or harm anyone.
• Do not probe, scrape, overload, reverse engineer, or bypass the app.
• Do not upload malware, spam, or content that violates rights or laws.
• Do not use shared links or shopper marks to expose surprise, identity, contact, or purchase information in a way the product is designed to keep private.

Cherry is in a soft-launch MVP state. Features may change, break, be removed, or have incomplete data. The app is provided as available and without warranties to the fullest extent allowed by law.

To the fullest extent allowed by law, Cherry is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost data; retailer issues; or purchases made outside Cherry. Nothing in these terms limits rights that cannot legally be limited.

You can stop using Cherry at any time. You can ask Cherry to delete or de-identify personal information associated with your account, subject to legal, security, fraud-prevention, and technical limits.

Cherry may update these terms as the product changes. Material updates will be reflected by changing the effective date on this page. Continuing to use Cherry after an update means you accept the updated terms.
